Functions, Responsibilities and Structural Organization of The Department for Service Economy
Decision No. 491/QD-BKH dated April 14, 2009 by the Minister of Planning and Investment.

Article 1. The Department for Service Economy is under the Ministry of Planning and Investment, and assists the Minister of Planning and Investment in performing the functions of state management over plans on development of service sectors, assumes the prime responsibility for such service sectors as tourism, domestic and international trade (including commodity and service trade).

Article 2. The Department for Service Economy shall have the following duties:

1. To study and consolidate strategies, master plans on development of domestic service sectors, tourism and trade (including border trade and border-gate economy) and international trade; to coordinate with related units under the Ministry to synthetize and elaborate national strategies for socio-economic development, territorial master plans and master plans on development of related branches.

2. To preside over, in coordination with related units, the consolidation of five-year and annual plans on development of service sectors (including: trade and business services; communication, transport and construction services; education, environment and technology and science services; financial and banking services; health-related, social, tourism, entertainment, sports and other services). To directly supervise domestic tourism and trade services (including border trade and border-gate economy) and international trade. To formulate aggregate supply and demand balance statements for major goods and services of the economy, import and export of goods and services, international trade balance.

3. To study, analyze and select domestic and overseas investment projects in the fields under the Department’s management. To act as the principal body in managing programs and projects as assigned by the Minister of Planning and Investment.

4. To assume the prime responsibility for studying, suggesting mechanisms and policies on development of domestic service and trade (including border trade and border-gate economy) and international trade; to work with related units under the Ministry in studying and suggesting mechanisms and policies on socio-economic development in five-year and annual plans. To directly formulate particular mechanisms, policies and legal documents as assigned by the Ministry. To act as the focal point in appraising mechanisms, policies and drafting legal documents of branches and fields under its management to be submitted to the Government Prime Minister for approval or promulgated within their competence.

5. To examine and monitor the implementation of master plans, plans, programs and projects (including ODA and FDI projects), reports on assessment of implementation of monthly, quarterly and annual plans of branches and fields under its management. To propose solutions for handling obstacles and difficulties faced in management and implementation of plans.

6. To work with related units under the Ministry in appraising projects, plans on bidding, selection of bidders for projects, bidding packages under the competence of the Government Prime Minister to be submitted to the Government Prime Minister for approval or authorization; to act as the coordinator in appraising projects in the fields under its management for decision by ministries, branches, localities within their powers; to assume the prime responsibility for investment supervision for investment programs and projects (using both domestic and foreign capital) in the branches and fields assigned by the Minister; to coordinate with related units in inspecting master plans on development of domestic service sectors, tourism and trade (including border trade and border-gate economy) and international trade.

7. To study, forecast, collect and systemize economic information in service of the formulation of master plans and plans on development of branches and fields under its management; to work with related units under the Ministry in processing and provision of information on development of service sectors, tourism, domestic trade (including border trade and border-gate economy) and international trade.

8. To preside over the consolidation of investment and development plans for the following branches and fields:

- With respect to service sectors: Tourism under the state management of the Ministry of Culture, Sports and Tourism; other services under the state management of specialized ministries which have not been assigned to other units under the Ministry;

- Domestic trade (including border trade and border-gate economy) under the state management of the Ministry of Industry and Trade;

- International trade (including export and import of goods and services, e-commerce) under the state management of the Ministry of Industry and Trade;

- Treasures under the management of Ministries and branches.

- National reserve sector (including materials, goods and treasures) under the Ministry of Finance and other Ministries and branches which perform the function of national reserve.

9. To consolidate international economic integration plans on services and import and export of goods and services (including international negotiation and international commitment fulfillment).

10. To fulfill other duties as assigned by the Minister of Planning and Investment.

Article 3. The Department for Service Economy is served by a Director General and a number of Deputy Directors and works under the specialist regime. The Department’s staffing is decided by the Minister of Planning and Investment.

Article 4. This Decision shall take effect from the date of signing. Regulations previously promulgated which are contrary to this Decision shall be annulled.

Article 6. The Director General of the Departmentfor Service Economy, the Director General of the Organization and Personnel Department, the Chief of the Ministry Office and heads of related units shall be responsible for implementing this Decision./.
