Functions, tasks, powers and organizational structure of the Department for Labour, Culture and Social Affairs

Decision No. 989/QD-BKHDT dated May 29th, 2023 by the Minister of Planning and Investment.

Article 1. Position and functions

Department for Labour, Culture and Social Affairs is an affiliated unit under the Ministry of Planning and Investment which helps the Minister perform state management functions on socio-economic development strategies, planning, plans and investment in the development of industries and fields: labor, society, health, culture, information, radio, television, news, physical education, sports and tourism.

Article 2. Tasks and powers

1. Researching and synthesizing strategies and planning for development of sectors and fields: labor, employment, poverty reduction, social protection; protecting and caring for children, the elderly, youth development and other social issues; protecting and caring for people's health and population; religion; state archives; culture, information (press, publishing); radio, television, news; sports; tourism; coordinating with relevant units in the Ministry to synthesize and build socio-economic development strategies, 5-year and annual socio-economic development plans for the whole country; and national, regional and territorial planning.

2. Presiding over synthesizing 5-year and annual plans on labor, employment, poverty reduction, wages, social insurance, social protection, policies for people with meritorious services, protection and care for children, the elderly, gender equality, youth development, family, social protection and prevention of social evils; protecting and caring for people's health and population; religion; state archives; culture; information, radio, television, news; fitness, sports and travel.

3. Presiding over the synthesis of medium-term and annual public investment plans; synthesizing a list of public investment programs, important national projects, tasks and projects using central budget capital under the medium-term public investment plan according to the field under the responsibility of the Department.

4. Presiding over the appraisal of investment policies, capital sources and ability to balance public investment capital for projects under approval authority, and decisions on investment policies of the Prime Minister for the sectors and fields under the responsibility of the Department. Presiding over giving opinions on national planning prepared and adjusted by ministries and ministerial-level agencies (specified in Clause 10, Article 2 of this Decision).

5. Presiding over the appraisal of plans and capital allocation plans for medium-term public investment plans of central budget capital of ministries and central agencies in the fields under the responsibility of the Department (excluding housing support for people with meritorious services to the revolution); participating in appraisal of national target programs and public investment programs according to the assigned fields of the Department.

6. Presiding over research, proposing and advising on mechanisms and policies for development of sectors and fields under the responsibility of the Department within the functions, tasks and powers of the Ministry of Planning and Investment. Participating in developing mechanisms, policies and draft legal documents of Ministries under the Department's responsibility.

7. Inspecting, monitoring and evaluating the implementation of plans, programs and projects of ministries, branches and central agencies within the scope of management of the sectors and fields under the responsibility of the Department. Reporting on the implementation of medium-term and annual public investment plans of ministries and central agencies under the Department's responsibility. Proposing solutions to handle problems in the process of managing and implementing the plan. Performing investment supervision of projects within the sectors and fields under the responsibility of the Department. Coordinating with units under the Ministry to monitor and manage the national target program for sustainable poverty reduction.

8. Researching and proposing mechanisms and policies to mobilize and using legal resources to develop services in the sectors and fields under the responsibility of the Department (except for the field of prize-winning entertainment - casino).

9 Researching and forecasting, collecting and systematizing socio-economic information for the development of planning and development plans for sectors and fields under the responsibility of the Department.

10. Acting as the focal point to synthesize the 5-year and annual development investment plans of: Ministry of Labour, War Invalids and Social Affairs; Ministry of Culture, Sports and Tourism; Ministry of Home Affairs; Ministry of Health; Voice of Vietnam; Vietnam Television; Vietnam News Agency; Vietnam Social Security; Vietnam General Confederation of Labour; Central Vietnam Women's Union; Central Ho Chi Minh Communist Youth Union and Unions under the responsibility of the Department.

11. Presiding or participating in guiding the implementation of legal regulations on investment and business for the industries and fields under the responsibility of the Department. Presiding and coordinating with relevant units to organize the codification and consolidation of legal documents in the sectors and fields under the responsibility of the Department according to regulations.

12. Carrying out other tasks as assigned by the Minister.

Article 3. Organizational structure

Department for Labour, Culture and Social Affairs has one Director General and a number of Deputy Directors General; The Department works under the Leader regime and Specialist regime; The Department’s staffing is decided by the Minister.

Article 4. Enforcement

This Decision has come into force since the date of signing and replaces the Decision No. 1899/QD-BKHDT dated December 22nd, 2017 by the Minister of Planning and Investment.

Article 5. Implementation responsibility

Director General of Department of Organization and Personnel, Chief of the Ministry Office, Director General of Department for Labour, Culture and Social Affairs and the heads of units and organizations under the Ministry are responsible for implementing this Decision./.
