Decision No. 899/QD-BKHDT dated May 15th, 2023 by the Minister of Planning and Investment.

Article 1. Position and functions

Department for Economic Zones Management is an affiliated unit under the Ministry of Planning and Investment which helps the Minister perform the function of state management of industrial zones and economic zones (including: industrial parks, export processing zones, coastal economic zones, specialized economic zones) nationwide; acts as a focal point to help the Minister research and propose mechanisms, policies, laws and monitor arising issues related to the construction and development of special administrative-economic units.

Article 2. Tasks and powers

1. Participating in developing directions for building industrial parks and economic zones in regional planning; coordinating the appraisal of plans to develop the system of industrial parks and economic zones in the provincial planning; acting as a focal point to guide and coordinate in evaluating the implementation of the plan to develop the system of industrial parks and economic zones in the provincial planning after being approved by competent authorities; acting as a focal point for comments on industrial park and economic zone construction planning.

2. Acting as a focal point to research and propose models of industrial parks and economic zones, mechanisms and policies for development and international cooperation related to industrial parks and economic zones; presiding over the development or participate in the development of legal documents on industrial parks and economic zones; participating in developing relevant legal documents, mechanisms and policies as assigned by the Minister.

3. Participating in building a national list of projects calling for domestic and foreign investment in industrial parks and economic zones in accordance with planning; participating in developing and organizing the implementation of plans, programs, and investment promotion activities in industrial parks and economic zones; participating with units under the Ministry of Planning and Investment in synthesizing and evaluating the situation of domestic investment and foreign direct investment in Vietnam; summarizing and evaluating the results and socio-economic efficiency of industrial parks and economic zones.

4. Presiding over or coordinating to organize appraisals related to industrial parks and economic zones, including the following tasks:

a) Presiding over organizing the appraisal of the establishment, expansion, and adjustment of economic zone boundaries according to the provisions of law;

b) Presiding over organizing appraisal and reporting to the Minister to submit to the Prime Minister for approval of investment policies or approval of the adjustment of investment policies of investment projects to build and operate infrastructure of industrial parks and export processing zones according to the provisions of the Law on Investment and other relevant laws;

c) Presiding over participating in appraisal and giving comments on investment projects in industrial parks and investment projects with production or multi-objective goals in economic zones other than the cases specified in Point b of this Clause;

d) Presiding over or coordinating to organize appraisal and comment on other investment projects assigned by the Minister.

5. Acting as a focal point or coordinate to perform the following tasks according to the state management powers and responsibilities of the Ministry of Planning and Investment:

a) Guiding on building eco-industrial parks, supporting industrial parks, specialized industrial parks, high-tech industrial parks, industrial-urban-service parks;

b) Guiding, inspecting and evaluating the implementation of state management functions of the Management Board of industrial parks, export processing zones and economic zones;

c) Guiding, inspecting and evaluating the implementation of investment projects on construction and business of infrastructure of industrial parks, export processing zones and functional areas in economic zones;

d) Guiding, inspecting, evaluating, resolving or assisting in resolving arising issues related to businesses and investment projects in industrial parks and economic zones, and the implementation of investment procedures in industrial parks and economic zones.

6. Presiding over the development and reporting to the Minister to submit to the competent authority for approval the list of key economic zones in each period; acting as a focal point or coordinating to propose mechanisms to mobilize capital sources to invest in developing economic zone infrastructure, the use of capital from the state budget for development investment and other legal capital sources to invest in the construction of economic zone infrastructure that is specific and important for the development of industries, fields, technical and social infrastructure works in key economic zones.

7. Presiding over or coordinating in building and managing the national information system on industrial parks and economic zones nationwide; presiding over announcing and providing information about industrial parks and economic zones as assigned by the Minister.

8. Presiding over guiding the implementation of legal regulations on investment and business in the sectors and fields under the responsibility of the Department. Presiding over organizing the implementation of legal codification and consolidation of legal documents in the sectors and fields under the responsibility of the Department according to regulations.

9. Acting as a focal point to advise and assist the Minister in carrying out the tasks of the Standing Steering Committee for the Development of Industrial Parks and Economic Zones and the Standing National Steering Committee for Construction of special administrative - economic units and other tasks assigned by competent authorities related to industrial parks and economic zones.

10. Presiding over the implementation of management tasks for unions and associations whose main fields of activity fall under the state management function of industrial parks and economic zones of the Ministry of Planning and Investment.

11. Performing other tasks as assigned by the Minister.

Article 3. Organizational structure

Department for Economic Zones Management has one Director General and a number of Deputy Directors General; Department for Economic Zones Management works under the Leader regime and Specialist regime; The Department’s staffing is decided by the Minister.

Article 4. Enforcement

This Decision has come into force since the date of signing and replaces the Decision No. 1889/QD-BKHDT dated December 22^nd, 2017 by the Minister of Planning and Investment.

Article 5. Implementation responsibility

Head of Department of Organization and Personnel, Chief of the Ministry Office, Head of Department for Economic Zones Management and the heads of units and organizations under the Ministry are responsible for implementing this Decision./.
