Functions, tasks, powers and organizational structure of the Department of Industrial and Service Economy

Decision No. 839/QD-BKHDT dated May 15th, 2023 by the Minister of Planning and Investment.

Article 1. Position and functions

Department of Industrial and Service Economy is an affiliated unit of the Ministry of Planning and Investment, which helps the Minister perform state management functions on development strategies, planning, plans, investment in developing industry, energy, services and trade.

Article 2. Tasks

1. Researching and synthesizing strategies, making national sector planning for sectors and fields of industry, energy, services and trade; coordinating with relevant units in the Ministry to synthesize and build the country's common socio-economic development strategy, national master planning, regional planning, and provincial planning.

2. Presiding over synthesizing 5-year and annual plans on the development of sectors and fields of industry, energy, service and trade.

Directly being in charge of industries, including: electricity, coal, petroleum, new energy, renewable energy, electronic industry, semiconductor circuits, chemicals, industrial explosives, mechanics, metallurgy, construction materials; mineral geology, mineral exploration, exploitation and processing; other processing and manufacturing industries; supporting industries, environmental industries, high-tech industries; industrial clusters; industrial promotion.

Directly being in charge of warehouses, services, and trade, including: logistics, border trade, border gate economy, goods trade, service trade.

3. Presiding over researching and proposing mechanisms and policies for development of industry, energy, services, trade, logistics, investment and business of golf courses; coordinating with relevant units in the Ministry to research and propose mechanisms and policies for socio-economic development. Directly drafting mechanisms, policies and specific legal documents when assigned by the Ministry. Acting as a focal point to participate in the appraisal of mechanisms, policies, programs, schemes, projects and draft legal documents of the sectors and fields under the responsibility of the Department for ministries and branches to submit to the Government and Prime Minister or promulgate according to their authority.

4. Reporting and assessing the implementation of monthly, quarterly and annual plans of the sectors and fields under the responsibility of the Department.

5. Acting as the focal point for evaluating the report proposing investment policies for the Public Investment Program; appraising capital sources and ability to balance public investment capital for group A projects under the Prime Minister's authority to decide on investment policies in the sectors and fields in charge; presiding over monitoring, managing and synthesizing public investment plans of the Ministry of Industry and Trade and Groups and Corporations in the industry and trade sector; presiding over the synthesis of public investment plans for programs and projects in sectors and fields using public investment capital, including: industry sectors; industrial clusters; border gate economic zones; warehouses; and trade.

Presiding over the appraisal of investment policies for projects approved by the Prime Minister, deciding on investment policies in the sectors and fields in charge according to the provisions of the Law on Public Investment, Law on Investment, and Law on Investment according to the public-private partnership method.

Presiding over the supervision and inspection of programs and projects using public investment capital and development investment capital from state budget sources in the sectors and fields in charge.

6. Presiding over providing opinions on national planning within the sectors and fields in charge (including planning on the national reserve warehouse system).

7. Researching, forecasting, collecting and systematizing economic information for the development of strategies, planning, and development plans for sectors and fields in charge; coordinating with relevant units in the Ministry to process and provide information on industry, energy, service, and trade development.

8. Presiding over the appraisal of strategies, production and business plans and 5-year investment and development plans of enterprises in which the State holds 100% of charter capital established by the Prime Minister's decision in the sectors and fields in charge; coordinating and giving opinions on the establishment, arrangement and reorganization of state-owned enterprises.

9. Presiding over or participating in guiding the implementation of legal regulations within the scope of state management of the Ministry for the sectors and fields in charge.

10. Summarizing plans for international economic integration in services. Presiding over the negotiations within the framework of the ASEAN Coordinating Committee on Services (CCS); coordinating to participate in negotiations in the service sector in international economic integration.

11. Coordinating with units under the Ministry to perform relevant tasks within the scope of management of the sectors and fields in charge.

12. Performing other tasks as assigned by the Minister.

Article 3. Organizational structure

Department of Industrial and Service Economy has one Director General and some Deputy Directors General; Department of Industrial and Service Economy works under the Leader mode and Specialist mode; The Department’s staffing is decided by the Minister.

Article 4. Enforcement

This Decision has come into force since the date of signing and replaces the Decision No. 1877/QD-BKHDT dated December 22nd, 2017 by the Minister of Planning and Investment on the functions, tasks and organizational structure of Department of Industrial Economy, and the Decision No. 1866/QD-BKHDT dated December 21st, 2017 by the Minister of Planning and Investment on the functions, tasks and organizational structure of Department of Service Economy.

Article 5. Implementation responsibility

Director General of Department of Organization and Personnel, Chief of the Ministry Office, Director General of Department of Industrial and Service Economy and the heads of units and organizations under the Ministry are responsible for implementing this Decision./.
