Decision No. 866/QD-BKHDT dated May 15th, 2023 by the Minister of Planning and Investment.
Article 1. Position and functions
The Department of National Defense, Security is an affiliated unit of the Ministry of Planning and Investment, representing the Minister to perform the state management functions on socio-economic development strategies, planning, development investment and linking socio-economic development with strengthening national defense and security in all fields and areas of the country; ensuring the needs for national defense and security in peacetime and wartime; development of mechanisms and policies related to national defense and security.
Article 2. Tasks
1. Implementing research, strategy, planning, and plans to ensure defense, security, and judicial needs; Coordinating with the Ministry’s relevant units to develop Vietnam’s common socio-economic development strategy, 5-year and annual socio-economic development plans, national master plan, and development plan associated with national defense and security requirements.
2. Presiding over synthesizing medium-term and annual public investment plans to ensure defense and security needs in peacetime and wartime, including sectors and fields of defense, security, and justice; Management Board of President Ho Chi Minh’s Mausoleum; Government Cipher Committee; Vietnam Veterans Association; National defense and security in key areas, borders, mainland, the East Sea - Islands; Ensuring traffic order and safety, fire prevention, crime and drug prevention; Defense and security industry.
3. Researching, proposing and reviewing investment projects and programs to ensure National Defense, security and justice in the fields in charge by the Department; Presiding over monitoring and management of programs and projects in the fields of National Defense, security and justice under the Ministry’s authority.
4. Presiding over appraising reports proposing investment policies for the Public Private Investment Program, investment policies for projects approved and decided by the Prime Minister in the sectors and fields in charge according to regulations of the law; Consulting on national planning within the sectors and fields in charge.
5. Presiding over researching, making recommendations and proposal for legal mechanisms and policies and ensuring the tasks of National Defense, security, justice, and overcoming the consequences of toxic chemicals after the war; anti-terrorism works, fire prevention and fighting and rescue; Grassroots police force; respond to incidents and natural disasters; Participating in developing projects of Laws, Ordinances, and other legal documents related to national defense and security under the Ministry’s management.
6. Inspecting, monitoring, synthesizing and reporting on the implementation of regular and irregular planning, plans, programs and projects according to regulations of the sectors and fields in charge by the Department; Proposing solutions to handle problems during plan implementation.
7. Researching, forecasting and collecting information on affairs of national defense, security, and justice related to socio-economic affairs to serve the development and management of plans.
8. Preside over synthesizing, managing, and monitoring public investment plans of ministries and sectors: Ministry of National Defense, Ministry of Public Security, Ministry of Justice, Supreme People’s Court, Supreme People’s Procuracy, Government Cipher Committee, Management Board of President Ho Chi Minh’s Mausoleum and Vietnam Veterans Association.
9. Presiding over and coordinating with the Department of Legislation to codify and consolidate legal documents in the fields in charge according to regulations.
10. Coordinating with the Ministry’s affiliated units to carry out relevant tasks under the management of the sector or field in charge.
11. Carrying out other tasks as assigned by the Minister.
Article 3. Organizational structure
The Department of National Defense, Security has one Director General and a number of Deputy Directors General; The Department’s staffing is decided by the Minister.
The Department of National Defense, Security’s leaders and specialists are seconded by the Ministry of National Defense and the Ministry of Public Security at the request of the Minister of Planning and Investment. The positions of Department of National Defense, Security’s leaders and specialists are equivalent to the positions of officers working in the Departments of the Ministry of National Defense and the Ministry of Public Security by the Minister of National Defense and the Minister of Public Security as regulated in agreement with the Ministry of Planning and Investment.
Article 4. Enforcement
This Decision comes into force since the date of signing and replaces the Decision No. 1886/QD-BKHDT dated December 22nd, 2017 by Minister of the Ministry of Planning and Investment on functions, tasks and organizational structure of the Department of National Defense, Security.
Article 5. Implementation responsibility
Director General of Department of Organization and Personnel, Chief of the Ministry Office, Director General of Department of National Defense, Security and the heads of units and organizations under the Ministry are responsible for implementing this Decision./.
