Decision No. 856/QD-BKHDT dated May 15th, 2023 by the Minister of Planning and Investment.

Article 1. Position and functions

The Department of Legislation is an affiliated unit of the Ministry of Planning and Investment, representing the Minister to monitor and perform the state management functions in accordance with the law and organize the strict implementation of legal activities under the Ministry’s authority.

 Article 2. Tasks

1. Presiding over planning and developing legal documents under the Ministry’s state management.

2. Presiding over developing or coordinating with the Ministry’s affiliated units to develop and organize the implementation of legal documents related to the Ministry’s state management.

3 Consulting on legal documents developed by ministries, agencies or localities as assigned by the Ministry’s Leadership.

4. Evaluating and giving opinions on legal documents drafted by the Ministry’s affiliated units before submitting to the Ministry’s Leadership.

5. Participating in evaluating and giving suggestions on investment projects as assigned by the Ministry’s Leadership and requested by the Ministry’s affiliated units.

6. Planning and guiding to review, systematize, codify, consolidate, and check legal documents, popularize, disseminate and educate legal affairs, monitor the enforcement of laws under the Ministry’s state management.

Presiding over and coordinating with the Ministry’s affiliated units to review, systematize, check legal documents and popularize, disseminate and educate legal affairs in investments and business.

Coordinating with the Ministry’s affiliated units to codify and consolidate legal documents in accordance with the law.

7. Presiding over negotiating international treaties on investments, investment content in free trade agreements; Taking charge or participating in negotiating international treaties, agreements and other activities related to international economic integration under the Ministry’s state management.

8. Presiding over or participating in guiding the implementation of international treaties and agreements mentioned in Paragraph 7 of this Decision.

9. Taking charge or participating in guiding the implementation of legal regulations on investment, business and other legal documents under the Ministry’s state management.

10. Carrying out the functions, tasks and powers of legal organizations according to the provisions of law.

11. Coordinating with the Ministry’s affiliated units to carry out relevant tasks under the management of the sector or field in charge.

12. Carrying out other tasks as assigned by the Minister.

Article 3. Organizational structure

The Department of Legislation has one Director General and a number of Deputy Directors General; The Department of Legislation works under the Leader regime and Specialist regime; The Department’s staffing is decided by the Minister.

Article 4. Enforcement

This Decision comes into force since the date of signing and replaces the Decision No. 1880/QD-BKHDT dated December 22^nd, 2017 by Minister of the Ministry of Planning and Investment on functions, tasks and organizational structure of the Department of Legislation.

Article 5. Implementation responsibility

Director General of Department of Organization and Personnel, Chief of the Ministry Office, Director General of Department of Legislation and the heads of units and organizations under the Ministry are responsible for implementing this Decision./.
