Decision No. 838/QD-BKHDT dated May 15th, 2023 by the Minister of Planning and Investment.

Article 1. Position and functions

Department of Investment Supervision and Appraisal is an affiliated unit under the Ministry of Planning and Investment, which helps the Minister perform the state management functions on supervising and inspecting investment activities; appraises and evaluates investment projects.

Article 2. Tasks

1. Presiding over research and drafting legal documents in the field of investment supervision, assessment and appraisal; providing guidance on investment appraisal, supervision and evaluation operations.

2. Acting as the focal point for synthesizing reports on overall investment monitoring and evaluation nationwide according to regulations; Preside over the overall supervision and inspection of investments of ministries, branches and localities according to approved plans or irregularly under the direction of competent authorities.

3. Carrying out tasks of the Standing Council of the State Appraisal Council with the Minister of Planning and Investment as Chairman of the Council: appraising investment policies and deciding on investment in national target programs and important national projects according to the provisions of the Law on Public Investment and the Law on Construction; appraising investment policies and investment projects decided by the National Assembly according to the provisions of the Law on Investment in the form of public-private partnership (PPP); appraising and approving project investment policies due to the National Assembly's approval of investment policies according to the provisions of the Law on Investment.

4. Presiding over the appraisal of investment policies for multi-sector and multi-field projects under the authority to approve and decide on investment policies of the Prime Minister (except for foreign investment projects in Vietnam and Vietnam’s overseas investment projects); presiding over the appraisal of investment policies and investment projects whose investment policies and decisions are decided by the Minister of Planning and Investment; coordinating with units in the Ministry to appraise investment policies for projects under its approving authority, and deciding investment policies of the Prime Minister, which are assigned to appraisal units.

5. Presiding over the implementation of projects and research topics in related fields. Presiding over research and application of investment appraisal, supervision and evaluation operations.

6. Presiding over and coordinating with Department of Legislation to organize the codification and consolidation of legal documents in the field under its responsibility according to regulations.

7. Coordinating with units under the Ministry to perform relevant tasks within the scope of management of the sectors or fields under its responsibility.

8. Carrying out other tasks as assigned by the Minister.

Article 3. Organizational structure

Department of Investment Supervision and Appraisal has one Director General and a number of Deputy Directors General; Department of Investment Supervision and Appraisal works under the Leader regime and Specialist regime; The Department’s staffing is decided by the Minister.

Article 4. Enforcement

This Decision has come into force since the date of signing and replaces the Decision No. 1869/QD-BKHDT dated December 21^st, 2017 by the Minister of Planning and Investment on the functions, tasks and organizational structure of Department of Investment Supervision and Appraisal.

Article 5. Implementation responsibility

Head of Department of Organization and Personnel, Chief of the Ministry Office, Head of Department of Investment Supervision and Appraisal and the heads of units and organizations under the Ministry are responsible for implementing this Decision./.
